Welcome to FamilyFrame.art ("we", "our" or "the Service"). By accessing or using our website and our AI image generation services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

FamilyFrame.art offers a service that allows users to upload personal photos to transform them into artistic illustrations using artificial intelligence technologies. The service is provided "as is" and the quality of the result depends on the quality of the images uploaded by the user.

3. User Responsibility

By using our service, you represent and warrant that you:

• Have the legal right and authority to upload the photos you use.
• Do not upload illegal, offensive, defamatory, pornographic content or content that violates third-party rights.
• Are at least 18 years old or have the consent of a parent/guardian.
• Do not use the service for fraudulent or harmful purposes.

4. Intellectual Property

Your Content: You retain all rights to the original photos you upload. By uploading them, you grant us a limited, non-exclusive, worldwide license to process them solely for the purpose of providing you with the requested service.

Generated Images: Once the order and payment are completed, we transfer the commercial rights to the generated images to you, which you may use for personal or commercial purposes.

5. Payments and Refunds

Payments are processed securely via Stripe. Due to the digital and personalized nature of the service (generation of unique content via AI), we cannot offer refunds once the generation process has started or completed, except in cases of proven technical malfunctions of our system.

6. Limitation of Liability

FamilyFrame.art shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the service. We do not guarantee that the service will be uninterrupted or error-free. Artificial intelligence can produce unpredictable results; the user accepts the risk that the generated image may not exactly match personal aesthetic expectations.

7. Privacy and GDPR Compliance

We take your privacy seriously and are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR - EU Regulation 2016/679).

• Legal Basis: We process your data (images and contact information) exclusively for the execution of the contract (provision of the image generation service) and for legal obligations.
• Data Retention: Uploaded images are used exclusively for the generation process and are automatically deleted from our processing servers within 24-48 hours. Generated images are retained to allow you to download them.
• User Rights: In accordance with the GDPR, you have the right to access your data, request rectification, deletion ("right to be forgotten"), limitation of processing, or portability.
• Third Parties: We do not sell your data to third parties. We use reliable service providers (e.g., Stripe for payments) who operate as data processors in compliance with the GDPR.
